These Terms of Service ("Terms") govern your use of Visual Mortgage, an iOS and iPadOS mortgage planning app provided by EYE MAN LLC ("EYE MAN LLC," "we," "us," or "our").
By downloading, installing, accessing, or using Visual Mortgage, you agree to these Terms. If you do not agree, do not use the app.
1. App Store Terms
Visual Mortgage is distributed through Apple's App Store. Your download, purchase, and use of the app may also be governed by Apple's applicable App Store, Apple Media Services, and Licensed Application End User License Agreement terms.
Unless EYE MAN LLC provides a separate custom end-user license agreement, Apple's Standard Licensed Application End User License Agreement applies to Visual Mortgage. These Terms are intended to supplement, not conflict with, Apple's applicable terms.
2. Educational and Planning Use Only
Visual Mortgage is provided for educational and planning purposes only. It helps you explore mortgage, affordability, refinance, rent-versus-buy, and related home-finance scenarios through estimates and visuals based on the assumptions you enter.
Visual Mortgage does not provide financial advice, legal advice, tax advice, investment advice, lending advice, underwriting decisions, credit decisions, loan approvals, or professional real estate guidance.
You are responsible for evaluating the assumptions, calculations, charts, exports, and scenarios shown in the app. Before making financial, legal, tax, real estate, or lending decisions, you should consult qualified professionals and verify terms with the relevant lender, advisor, professional, or authority.
3. Estimates and Assumptions
Visual Mortgage calculations, charts, summaries, and exports are estimates. They may not reflect your full situation, local laws, lender requirements, insurance costs, taxes, closing terms, underwriting requirements, market conditions, or other facts that may affect an actual transaction.
You are responsible for the accuracy and completeness of information you enter into the app.
4. Purchase, Pricing, and Refunds
Visual Mortgage is currently offered as a paid-upfront app through the App Store. The app does not currently include subscriptions, in-app purchases, user accounts, or paid account tiers.
Prices, taxes, billing, Family Sharing availability, refunds, and purchase support are handled by Apple under Apple's App Store policies. EYE MAN LLC does not process App Store payments directly.
5. Local Data and Privacy
Visual Mortgage is designed as a local, on-device planning tool. The app stores scenarios and app preferences locally on your device and does not require an account.
The app does not currently provide cloud sync, EYE MAN LLC server-side storage, third-party analytics SDKs, crash-reporting SDKs, advertising SDKs, or tracking SDKs.
Your use of the app is also governed by the Visual Mortgage Privacy Policy.
6. Sharing and Exports
Visual Mortgage may let you export or share scenario information as JSON or PDF files. These exports may include scenario names, entered assumptions, calculated results, charts, and other scenario details.
Exports are generated locally. If you choose to share an export using Mail, Messages, Files, AirDrop, cloud storage, or another destination, you are responsible for that sharing choice and for the destination service's terms and privacy practices.
7. Acceptable Use
You agree not to use Visual Mortgage to:
- violate any law, regulation, or third-party right
- attempt to reverse engineer, copy, modify, or distribute the app except as allowed by applicable law or Apple's applicable terms
- interfere with the app's normal operation
- misuse exports or shared files in a way that misrepresents the app's estimates as professional advice, lender terms, or guaranteed outcomes
- use the app in connection with unlawful, deceptive, or harmful conduct
8. Ownership
Visual Mortgage, including its design, code, charts, text, visual presentation, workflows, and other app content, is owned by EYE MAN LLC or its licensors and is protected by intellectual property laws.
These Terms do not transfer ownership of the app or its content to you. You receive only the right to use the app as permitted by these Terms and Apple's applicable terms.
9. Updates and Availability
EYE MAN LLC may update, modify, suspend, or discontinue Visual Mortgage or any app feature at any time. Updates may change calculations, chart behavior, supported scenario fields, export formats, or local storage behavior.
EYE MAN LLC is not responsible for data loss caused by device failure, operating-system behavior, deletion of the app, lack of backups, or other circumstances outside EYE MAN LLC's control.
10. Third-Party Services
Visual Mortgage may interact with Apple services or system features, such as the App Store, iOS, iPadOS, Files, Mail, Messages, AirDrop, device backups, and system share sheets. Those services are provided by Apple or other third parties and are governed by their own terms and privacy practices.
EYE MAN LLC is not responsible for third-party services, websites, platforms, or destinations you use with exported files.
11. No Warranties
To the maximum extent permitted by law, Visual Mortgage is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise.
EYE MAN LLC does not warrant that the app will be uninterrupted, error-free, accurate for your particular situation, or suitable for any specific financial, legal, tax, lending, investment, real estate, or professional purpose.
Some jurisdictions do not allow certain warranty exclusions, so some of the above exclusions may not apply to you.
12. Limitation of Liability
To the maximum extent permitted by law, EYE MAN LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost opportunities, lost data, or decisions made based on app estimates, charts, summaries, or exports.
To the maximum extent permitted by law, EYE MAN LLC's total liability for claims related to Visual Mortgage will not exceed the amount you paid to purchase the app.
Some jurisdictions do not allow certain liability limitations, so some of the above limitations may not apply to you.
13. Changes to These Terms
EYE MAN LLC may update these Terms from time to time. Updated Terms will include a new effective date. Your continued use of Visual Mortgage after the Terms are updated means you accept the updated Terms.
